Our DMCA agent information is registered with the U.S. Copyright Office and is searchable under "Venture Software LLC" and "Pixerr."
If you believe that Content hosted on Pixerr infringes your copyright, you may submit a DMCA takedown notice to our designated agent. To be valid under the DMCA, your notice must include the following information:
Notices that do not contain all of the required information may not be processed or may be delayed.
Upon receipt of a valid DMCA takedown notice, Pixerr may take one or more of the following actions:
Pixerr does not act as an arbitrator or adjudicator of infringement disputes. We process notices and counter-notices in good faith according to the DMCA.
If your Content has been removed or disabled as a result of a DMCA takedown notice, and you believe that the removal was a mistake or that you have the right to use the material, you may submit a counter-notification to our DMCA agent. Under the DMCA, a valid counter-notification must include:
After receiving a valid counter-notification, Pixerr may forward a copy to the original complainant. If we do not receive notice within a reasonable period (typically 10–14 business days) that the complainant has filed an action seeking a court order to prevent further infringement, we may restore the removed Content.
In appropriate circumstances, Pixerr may terminate user accounts that are determined to be repeat infringers. We also reserve the right to remove Content, suspend accounts, or take other appropriate action against any user who repeatedly or egregiously violates the intellectual property rights of others, whether or not a formal DMCA notice is received.
Submitting false or bad-faith DMCA notices or counter-notifications may have serious legal consequences. You may be liable for damages, including costs and attorneys' fees, if you knowingly misrepresent that material or activity is infringing or was removed by mistake. If we determine that you have abused the DMCA process, we may suspend or terminate your account and take any other action we deem appropriate.
